This application for regular bail arises out of Banka P.S. Case No. 576 of 2019, disclosing the offences under Sections 30(a) and 37(b) of the Bihar Prohibition Act, 2016 and amendment 2018.

The petitioners were apprehended by the Police in inebriated condition and subsequently on search, illicit country made liquor was recovered from their possession. Learned counsel appearing on behalf of the petitioners has submitted that only 6 litres of illicit country made liquor is said to have been recovered from the possession of the

Patna High Court CR. MISC. No.10551 of 2020(2) dt.02-03-2020 2/2 petitioners. He has also submitted that the petitioners shall present themselves before the court as and when required in connection with the present Criminal Case. The petitioners are in custody since 21.01.2020.

Considering the nature of allegation, this application is allowed. Let the petitioners, above-named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand), with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Banka, in connection with Banka P.S. Case No. 576 of 2019, subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the court on two consecutive occasions, their bail Bonds shall be liable to be cancelled.
