JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2019 The petitioner apprehends his arrest in connection with Revilganj P.S.Case No. 342 of 2018 registered under Sections 30(a) and 37(a)(c) of the Bihar Prohibition and Excise Act. Allegation of recovery of 15 litres of country made liquor from an orchard and it is alleged that petitioner fled away from the place of occurrence.

Submission of learned counsel for the petitioner is that nothing has been recovered from the possession of the petitioner or from his house rather recovery is made from an orchard of Shankar Manjhi and from the Adda of the petitioner. He has not been arrested and he has been made accused on the basis of disclosure of his name by co-accused and petitioner has no criminal antecedent.

Having heard both sides and in the facts and

No.11871 of 2019(2) dt.27-02-2019 2/2 circumstances, as stated above, let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned 6th ADJ, Saran at Chapra in connection with Revilganj P.S. Case No. 342 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
