1. Heard learned counsel for the parties.
2. The petitioners have preferred this application for grant of regular bail in connection with Barauni P.S. Case no. 485 of 2023, registered under sections 302, 304B, 498A and 34 of the Indian Penal Code and sections 3 and 4 of the Dowry Prohibition Act.
3. As per the prosecution case, the informant states that his daughter, who was married to one Sujit Kumar, was tortured by the accused persons including the petitioners
Patna High Court CR. MISC. No.14502 of 2024(2) dt.12-03-2024 2/3 herein. The said Sujit Kumar made a demand of Bullet motorcycle. The informant's daughter was done to death by the accused persons after strangulating her.
4. Learned counsel for the petitioners submits that the petitioners happen to be the father-in-law and brother-inlaw (elder brother of the husband) of the deceased. The allegations are general and omnibus in nature. The husband of the deceased is in custody and the petitioners are in custody since 17.9.2023. Charge-sheet has been submitted in the case.
5. The application for bail is opposed by learned A.P.P for the State.
6. Having heard learned counsel for the parties and taking into consideration the nature of allegation against the petitioners who are the father-in-law and brother-in-law of the deceased being general and omnibus in nature, the petitioners being in custody since 17.9.2023, their not having any criminal antecedent and specially the husband of the deceased being in custody, both the petitioners are directed to be enlarged on bail in connection with Barauni P.S. Case no. 485 of 2023 on each of them furnishing bail bond of
Patna High Court CR. MISC. No.14502 of 2024(2) dt.12-03-2024 3/3 Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai.
