Petitioner, already in custody, seeks bail in connection with Patori P.S. Case No.392 of 2017, registered under Sections 8, 20(b), (ii) (8) of the NDPS Act.
Learned counsel for the petitioner submits that the son of the petitioner was identified going away with the motorcycle and left the vehicle, the petitioner was implicated on the basis that the motorcycle registration stands in his name and there is recovery of 2.75 Kgs. of Ganja from the motorcycle kept in a bag, which is not of commercial quantity.
Having considered the said facts and circumstances, petitioner Pramod Sah is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two
Patna High Court Cr.Misc. No.14631 of 2018(2) dt.15-03-2018 2/2 sureties of the like amount each to the satisfaction of learned Sessions Judge, Samastipur in connection with Patori P.S. Case No.392 of 2017 with the following conditions:
(1) One of the family members must be the close family member of the petitioner.
(2) The petitioner shall remain physically present on each and every date before the trial court and if he absents himself on two consecutive dates without any reasonable cause, his bail bond shall liable to cancelled.
(3) If the petitioner is found involved in similar offence in future, the bail bond of the petitioner shall liable to be cancelled. (Arun Kumar, J) S.KUMAR/- U T
