Petitioner seeks bail in Raghunath Pur P.S. Case No. 76 of 2008 for the offence punishable under Section 395 of the Indian Penal Code.

As per the written report dacoity has been committed in the house of the informant. The informant is said to have identified the accused persons namely Saral Shah and Rajesh Shah. The petitioner is not named in the FIR. From the order of the learned Sessions Judge, it appears that his name has come in the confessional statement of co-accused Saral Shah in paragraph no. 36 of the case diary. The petitioner has also got no criminal antecedent as mentioned in paragraph no. 3 of this petition.

No.20837 of 2017 (2) dt.08-05-2017 2/2 Considering the above facts and circumstances, this petition for bail is allowed and the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Raghunath Pur P.S. Case No. 76 of 2008 to the satisfaction of learned A.C.J.M.-IV, Siwan subject to the condition that both the bailors should be close relatives of the petitioner.
