The petitioner seeks bail in Korma P.S. Case No. 57 of 2016 registered for the offence punishable under Sections 304(B)/34 of the Indian Penal Code and Section 3/4 D.P. Act. Informant is the uncle of deceased who has lodged complaint case before the C.J.M. Sheikhpura which was referred to the police under Section 156(3) of the Cr.P.C for which Korma P.S. Case No. 57 of 2016 was registered. The complaint was filed after nine days of the occurrence. It has been submitted by the learned counsel for the petitioner that petitioner has been falsely implicated in this case and after ten days of death of his deceased-wife who died on account of illness and her in-laws were present at the time of

Patna High Court Cr.Misc. No.14550 of 2018(3) dt.09-04-2018 2/2 cremation as well as on the occasion of Shradh and thereafter with ulterior motive, the uncle of the deceased has filed complaint case which was referred to police for registration of FIR. He has denied any demand of dowry and nothing incriminating has been found against him. The petitioner has got no criminal antecedent and is in custody since 05.02.2017. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Sheikhpura in connection with Korma P.S. Case No. 57 of 2016.
