The petitioner seeks bail in Madhepura P.S. Case No. 924 of 2019 registered under Sections 302/34 of the Indian Penal Code.

The informant alleged that Ganesh Mistry, Akali Devi and Shilpi Devi(daughter-in-law) of Ganesh Mistry took the son of the informant(Ranjit Mistry) with them but on the next day, informant got information that his son was killed. The informant further disclosed that Ganesh Mistry, Akali Devi and Shilpi Devi conspired with Shyam Sundra Mistri and killed his son. The learned counsel for the petitioner submits that petitioner is not named in the F.I.R. Shyam Sundra Mistri who is alleged to have conspired with Ganesh Mistry and others and killed the son of the informant has already been granted bail by

Patna High Court CR. MISC. No.10710 of 2020(2) dt.28-02-2020 2/2 order dated 20.01.2020 passed in Cr. Misc. No.1077 of 2020. The name of the petitioner figured in the case in the confessional statement of Shyam Sundra Mistri and Sanjay Yadav. Save and except the confessional statement of coaccused, there is no material against the petitioner. Considering the facts that name of the petitioner figured in the case in the confessional statement of Shyam Sundra Mistri who is alleged to have conspired with Ganesh Mistry and others in killing Ranjit Mistry but Shyam Sundra Mistri has already been enlarged on bail by a co-ordinate Bench of this Court, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in connection with Madhepura P.S. Case No. 924 of 2019.
