====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 11-04-2018 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with POCSO Case No. 8 of 2018 arising out of Ghoshi P. S. Case No. 191 of 2017 instituted for the offenses punishable under Section 366A of the Indian Penal Code and Section 4 of the POCSO Act.

The allegation, as per written report of the informant is that her minor daughter, aged about 15 years has appeared in Matriculation examination, was abducted by the petitioner and his family members.

It is submitted by the learned counsel for the petitioner that the girl was recovered and her statement was recorded under Section 164 of the Cr. P. C. in which she has

Patna High Court Cr.Misc. No.15335 of 2018(3) dt.11-04-2018 2/2 stated that she had gone with the petitioner on her own sweet will. It is further been submitted that she was not abducted by the petitioner but she wants to live with the petitioner and marriage knot has already been tied up by both of them. The petitioner is in custody since 06.09.2017.

Considering the facts and circumstances and the materials on record, let the petitioner, above named be released on bail on furnishing bail bond of Rs. 10,000/- ( Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, 1st-Cum -Special Judge, Jehanabad in connection with POCSO Case No 08/2018 arising out of Ghoshi P.S.Case No. 191 of 2017.
