The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 379/427/34 of the Indian Penal Code.
It is alleged that the petitioner along with 3-4 unknown persons cut the 'Sagwan' trees of the informant and while they were taking some of them, it was witnessed by the informant but the petitioner flee away from the scene. It is submitted by learned counsel for the petitioner that due to previous dispute with the informant the accusation has been levelled and nothing has been recovered from the possession of the petitioner. It is further submitted that at the
Patna High Court Cr.Misc. No.10865 of 2015 (2) dt.24-04-2015 2/2 time of occurrence the petitioner was at Birganj in Nepal. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Awtar Nagar P.S. Case No.166 of 2013, pending before the Chief Judicial Magistrate, Saran at Chapra.
With the above observation, this application is, accordingly, disposed off.
