Petitioner seeks bail in Bachhwara P.S. Case No.26 of 2017 for the offence punishable under Section 30(A) of the Bihar Prohibition of Excise Act, 2016.

It is alleged that 20 pieces of foreign liquor of Royal Stag each containing 375 ml. were recovered from the bag, which is alleged to belong to the petitioner. From the written report, it appears that one person managed to run away after putting the bag and the petitioner was arrested. The petitioner is in custody since 25.02.2017. The petitioner has also got no criminal antecedent as mentioned in paragraph no. 3 of this petition. Considering the above facts and circumstances,

Patna High Court Cr.Misc. No.20843 of 2017 (2) dt.08-05-2017 2/2 this petition for bail is allowed and the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Bachhwara P.S. Case No.26 of 2017 to the satisfaction of learned Chief Judicial Magistrate, Begusarai subject to the condition that both the bailors should be close relatives of the petitioner.
