2. The petitioner seeks regular bail in connection with Baijnathpur P.S. Case No. 117 of 2024 registered for the offence under Sections 137(2), 87 of the Bharatiya Nyaya Sanhita, 2023. Later on charge-sheet submitted under Sections 137(2), 96, 65(1) of the Bharatiya Nyaya Sanhita, 2023, Section 4 & 6 of the POCSO Act and Section 9 of Child Marriage Prohibition Act.
3. Though the allegation against the petitioner is of kidnapping the victim girl but from the statement of the victim girl recorded under Section 183 BNSS, it appears that she had
Patna High Court CR. MISC. No.13903 of 2025(3) dt.09-05-2025 2/2 eloped with the petitioner on her own and they have got married. The petitioner is in custody since 26.11.2024.
4. Considering the statement of the victim girl, this application for regular bail is allowed.
5. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J-V-cum-Spl Judge, POCSO Act, Saharsa/concerned Court below in connection with Baijnathpur P.S. Case No. 117 of 2024.
