Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 118(1), 326(F), 76, 109 and 303(2) of the Bharatiya Nyaya Sanhita.

Learned counsel for the petitioners submits that

No.16228 of 2025(4) dt.23-07-2025 2/3 petitioners are persons with clean antecedent except petitioner No. 3 who has antecedent of one case and allegation is of assaulting the informant's husband and son and acting inappropriately with her daughter-in-law. Further, it is alleged that Dilip assaulted Surendra with farsa causing injury on head, thereafter Bittu and Ravi Ranjan assaulted her husband by rod causing injury, who tried to save his son, thereafter all the accused persons assaulted her and her another son, Hiraman, by iron rod causing injury, thereafter Subodh took Rs. 1 lakh along with jewellery worth Rs. 2 lakhs.

Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that the injury suffered by the injured is simple in nature, as would manifest from the injury report. It is also submitted that on account of dispute which was existing in between the side of the petitioners and the informant on account of land, as such both parties assaulted each other. It is further submitted that had the petitioners assaulted in the manner as alleged, in that event the injury would not have been opined as simple. It is next submitted that petitioners will not abscond rather will cooperate in the investigation to prove their innocence.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Jharokhar P.S. Case No. 44 of 2024, subject to the conditions as laid down under Section 482 (2) of the BNSS.
