The petitioner seeks bail in Murliganj P.S. Case No. 116 of 2017 registered under Section 392 of the Indian Penal Code.
Nine motorcycle borne criminals are said to have looted the motorcycle of the informant on way on the point of weapon.
It is submitted by learned counsel for the petitioner that the petitioner is neither named in the F.I.R. nor any incriminating article has been recovered from his conscious physical possession. He has no concern with the aforesaid occurrence. The petitioner has been falsely implicated in this case
Patna High Court Cr.Misc. No.15307 of 2018 (02) dt.19-03-2018 - 2 - at the instance of his enemy. There is nothing on the record indicating the complicity of the petitioner in the occurrence barring the confessional statements of co-accused, Rajesh Kumar alias Rajesh Tiger, Mantosh Kumar alias Mister and Kanhaiya Kumar Yadav which has no evidentiary value in the eye of law. The petitioner has been languishing in custody since 16.12.2017. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in connection with Murliganj P.S. Case No.116 of 2014.
