2. The petitioners seek bail in connection with Katoriya P.S. Case No. 86 of 2004 instituted for the offences under Sections 341, 353, 333, 336, 307/34 of the Indian Penal Code.

3. Prosecution story, in short, is that petitioners along with other accused persons attacked a forest officer's team with gunfire and stones during a seizure but the team escaped safely.

4. Learned counsel for the petitioners submitted that petitioners have falsely been implicated in the present case. Learned counsel for the petitioners submits that general and

Patna High Court CR. MISC. No.13811 of 2025(5) dt.18-06-2025 2/2 omnibus allegation has been made against these petitioners. No specific overt act is alleged against these petitioners. Learned counsel further submitted that in the said incident no one sustained any type of injury. Charge-sheet has been submitted in this case. It has been submitted on behalf of the petitioners that the petitioner no. 1 is in custody since 12.12.2024 and petitioner no. 2 is no custody since 13.12.2024. Petitioners have got no criminal antecedent.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioners.

6. Considering the aforesaid facts and circumstances of the case the period of custody undergone by the petitioners, this Court is inclined to grant bail to the petitioners.

7. Let the petitioners be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Katoriya P.S. Case No. 86 of 2004.
