JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-05-2017 This is an application for grant of bail for offences punishable under Sections 302/34 of the Indian Penal Code. Earlier petitioners had moved before this Court with prayer for bail vide order dated 10.02.2017 passed in Cr. Misc. no. 2930of 2017 with an observation that they may renew their prayer for bail after framing of charge.

It has been submitted on behalf of the petitioners that charge has already been framed in this case which will appear from para-15 and Annexure-7 to the petition. Petitioners have remained in custody for about 5 1⁄2 months.

Having heard both sides, in view of the observation of this Court made earlier, petitioners have remained in custody for

No.21128 of 2017 (2) dt.03-05-2017 2/2 51⁄2 months and charge has been framed, let above named petitioners be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty-five thousand only) each with two sureties of the like amount each to the satisfaction of learned 2nd Addl. Sessions Judge, Purnea, in connection with S. T. no. 88 of 2017 with the following conditions:- (i) One of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the court concerned. (ii) The petitioners will not induce any witness or tamper with the evidence.

(iii) The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court and in the event of failure on their part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of their bail.
