JUSTICE ASHUTOSH KUMAR ORAL ORDER 02-03-2020 The petitioner has misused the privilege of bail which was granted to him on 30.04.2004 in connection with Sessions Trial No. 214 of 2019, arising out of Buxar P.S. Case No. 68 of 2002 dated 15.11.2002 instituted for the offence under Section 395 of the Indian Penal Code.

For the reasons explained in the bail petition and taking into account the fact that the petitioner is in custody since 01.12.2019 and the case has not progressed any further except for filing of the charge sheet, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 14th Additional Sessions Judge, Bhojpur at Ara in connection with Sessions Trial

Patna High Court CR. MISC. No.11401 of 2020(27) dt.02-03-2020 2/2 No. 214 of 2019, arising out of Buxar P.S. Case No. 68 of 2002.

At the time of grant of bail, the petitioner would be required to furnish an undertaking that he shall participate in the trial and his absence from the trial proceedings on two consecutive dates without permission of the trial court, shall make his bail liable to be cancelled and for which necessary process would be initiated by the concerned court, in case of default. The application stands allowed.
