The petitioner seeks bail in K. Hat P.S. Case No. 618 of 2016, registered for the offences punishable under Sections 413, 414 and 34 of the Indian Penal Code.

The informant police officer alleged that three persons started fleeing away leaving a red coloured motorcycle. Two persons Madhav Jha @ Chhotu Jha @ Chottu and Ashutosh Mishra @ Gidri were apprehended and they disclosed that they committed theft of a motorcycle about 20 days ago. Learned counsel for the petitioner submits that the motorcycle was not recovered from the possession of the petitioner and no case is registered for the theft of the aforesaid motorcycle. The petitioner is in jail since 31.12.2016.

No.21113 of 2017 (2) dt.09-05-2017 2/2 Considering the nature of allegation made against the petitioner and the fact that the petitioner has remained in jail for more than four months, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Purnea in K. Hat P.S. Case No. 618 of 2016.
