The petitioners apprehend their arrest in Amarpur (Fullidumar) P.S. Case No. 640 of 2020, registered for the offences punishable under Sections 307, 354 and other allied sections of the Indian Penal Code.

As per the prosecution case, on 26.10.2020 one Suman Yadav was laying foundation of his house on the land of informant and when the informant protested, all the accused persons including petitioners assaulted the informant with lathi,

Patna High Court CR. MISC. No.12630 of 2022(2) dt.16-08-2022 2/2 danda, iron rod causing injury. It is further alleged that when wife of informant came to rescue, the accused persons snatched away her ornaments.

It is submitted that due to land dispute between the parties the scuffle took place in which both sides sustained injury. Case and counter case. Allegation of assault is general and omnibus. Petitioners claim clean antecedent. Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Banka in connection with Amarpur (Fullidumar) P.S. Case No. 640 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) vinita/- U T
