====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 05-04-2024 Heard learned counsel for the petitioner and learned counsel for the Bihar State Food and Civil Supplies Corporation Ltd., Patna.
2. The present writ petition has been filed for directing the respondents to make appointment of the petitioner on compassionate ground on Class-IV post as the petitioner's father died on 11.11.1999 from Bihar State Food and Civil Supplies Corporation Ltd., Saharsa, Bihar
3. Learned counsel for the petitioner submits that the petitioner has filed representation vide Annexure-6 series for his
Patna High Court CWJC No.4530 of 2020(3) dt.05-04-2024 2/3 appointment and according to him, no response has come from The Managing Director, Bihar State Food and Civil Supplies Corporation Ltd., Patna (respondent No.2).
4. Learned counsel for the Bihar State Food and Civil Supplies Corporation Ltd., Patna submits that a time may be granted to file the counter affidavit.
5. From the record of this case, it transpires to this Court that the present writ petition has been filed in the month of February, 2020 and after a lapse of about 4 years, no counter affidavit has been filed in this case and this is the attitude of the Bihar State Food and Civil Supplies Corporation Ltd., Patna.
6. The situation is extremely pathetic and this Court hereby not inclined to grant any further time to the Bihar State Food and Civil Supplies Corporation Ltd., Patna.
7. This Court hereby directs The Managing Director, Bihar State Food and Civil Supplies Corporation Ltd., Patna (respondent No.2) to pass a reasoned and speaking order on the representation filed by the petitioner which is annexed as Annexure-6 series duly recommended by Annexure-4 within 90 days from the date of production of the order.
8. In case, the said representation is not found anywhere in the department, then intimation in this regard shall
Patna High Court CWJC No.4530 of 2020(3) dt.05-04-2024 3/3 be given to the petitioner and the petitioner shall file a fresh representation within 30 days thereafter.
9. Since the general elections of Lok Sabha, 2024 has been notified, the counting of the said 90 days shall be started from the end of the general elections of Lok Sabha, 2024.
10. With the aforesaid observations and directions, this writ petition is hereby disposed off.
