The petitioners are languishing in custody since 21.10.2018 in a case registered for the offence punishable under Section 414 of the Inidian Penal Code.

The prosecution case as per the written report of A.S.I., Jai Narayan Rao submitted to SHO, Alamnagar Police Station is to the effect that during regular vehicle checking, three persons were found travelling on a motorcycle. When signal was given to them to stop, they left the motorcycle and started fleeing away. Thereafter, on chase being made two

No.13984 of 2019(2) dt.08-03-2019 2/3 persons were apprehended, who disclosed their names as Ravi Shankar Kumar @ Ravi Shankar (petitioner no.1) and Gulshan Kumar (petitioner no.2) and they also disclosed the name of person as Babloo Mandal, who escaped from place of occurrence. It is further alleged that when the documents of the motorcycle were demanded, they failed to produce the same, hence it was suspected that the motorcycle was stolen. It is submitted by learned counsel for the petitioners that in fact, the petitioners only took a ride on the alleged motorcycle and they have no concern with the alleged motorcycle. It is further submitted that investigation has already been concluded. A statement has been made in paragraph no. 3 of the petition that the petitioners are not having any criminal antecedent.

Learned APP for the State submits that the petitioners were found travelling on the alleged motorcycle. Considering the fact that investigation has already been concluded, coupled with statement made in paragraph no. 3 of the petition that the petitioners are not having any criminal antecedent, let the above named petitioners be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of
