The petitioner seeks bail in a case for the offence registered under Sections 341, 323, 498(A), 376/34 of the IPC and 3⁄4 of the D.P. Act.
The prosecution story, in brief, is that the informant's sister married with Ashutosh Kumar. After some time of marriage, Ashutosh Kumar started demanding Rs. 2,00,000/- in cash, colour T.V. and Freeze from his sister. On refusal, her mother-in-law, nanad and father-in-law started torturing her. On 22.04.2019, her father-in-law misbehaved with her. When she made complaint to her mother-in-law, her mother-in-law also made allegation to her. Thereafter, her father-in-law established physical relationship with her.
Patna High Court CR. MISC. No.12722 of 2020(2) dt.05-03-2020 2/2 It has been submitted by learned counsel for the petitioner that the petitioner is in custody since 13.10.2019. The petitioner has got no criminal antecedent. He has falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The informant of the present case is the brother of the victim. The victim is the daughter-in-law of this petitioner. The victim has not instituted the present case. The victim and the informant (brother of the victim) made applications before the learned court below where they denied the allegations made in the F.I.R. annexed as Annexures- 3 and 4 to the present application. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Nawada, in connection with Mahila P.S.
