JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 343 and 364/34 of the Indian Penal Code.
The husband of the informant went missing when suspicion was raised against the FIR named accused persons including the petitioners since there was some land dispute from before.
It is submitted by learned counsel for the petitioners that considering the suspicious nature of accusation, other similarly situated accused persons have been granted anticipatory bail by this Court vide Cr. Misc. Nos. 17458 of 2013, 50847 of 2013 and 52479 of 2013. A statement has been made in para 3 of the
Patna High Court Cr.Misc. No.6394 of 2015 (2) dt.18-02-2015 2/2 petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gaya in connection with Buniyadganj P.S. Case No. 101 of 2012, subject to the conditions as laid down under Section 438(2) Cr.P.C.
