JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-12-2017 Heard learned counsel for the petitioner, learned counsel appearing on behalf of O.P. No.2 and the learned A.P.P. for the State. The petitioner apprehends his arrest in connection with Mahila P.S. Case no. 07 of 2017, registered under Section 323, 341, 307, 504/34 and 498(A) of the Indian Penal Code, Section 3/4 Dowry Prohibition Act and Section 3/4 of the Domestic Violence Act. The accusation is of torturing of informant by her husband and other in-laws due to non-fulfillment of demand of dowry and removing her along with her child from matrimonial house. It is further alleged that informant was assaulted by the petitioner and other in-laws reaching at her Myaka.

Learned counsel for the petitioner submits that on the joint prayer of the parties the matter was referred to Mediation Centre, Patna High Court, Patna for settlement of dispute between the parties, who are husband and wife, but mediation could not be succeeded.

Patna High Court Cr.Misc. No.22841 of 2017 (4) dt.06-12-2017 2/2 On the other hand learned counsel appearing on behalf of O.P. No.2 submits that O.P. No.2 still wants to live with the petitioner on the undertaking of the petitioner that he will keep her with full dignity.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Purnia in connection with Mahila P.S. Case No. 07 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
