The petitioner seeks bail in a case registered for the offence punishable under Sections 147, 148, 149, 323 and 302 of the Indian Penal Code.

Earlier, prayer for bail of the petitioner was rejected vide order dated 05.01.2022 passed in Cr. Misc. No. 64485 of 2021.

It is submitted by learned counsel for the petitioner that petitioner is innocent and has been falsely implicated in this case. There is a subsisting land dispute between the parties. He submits that there is general and omnibus allegation levelled against the petitioner. He submits that the charge has been framed against the petitioner. He further submits that petitioner has no criminal antecedent as stated in

Patna High Court CR. MISC. No.12713 of 2022(3) dt.06-07-2022 2/2 para-3 of this application and he is languishing in judicial custody since 17.01.2020.

Learned APP for the State opposes the prayer for bail and submits that petitioner is the main accused in this case. Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Sessions Trial No. 66 of 2022 arising out of Chapra Muffasil P.S. Case No. 509 of 2019.

However, trial court is directed to expedite the trial.
