In this case, the petitioner is seeking regular bail in connection with Akbarpur P.S. Case No. 40 of 2019 registered for offence punishable under sections 302, 201/34 of the Indian Penal Code.

Allegation has been made that Mukesh Yadav was called and killed. The dead body of Mukesh Yadav was found. During investigation it has transpired that wife of Ajay Yadav had illicit relationship with Mukesh Yadav (deceased). A conspiracy was held to finish Mukesh Yadav, who was called and Ajay Yadav assaulted the victim by hard and blunt substance and thereafter, the victim died, at the same time, cut mark of blade was found on both hands of the victim. Patna High Court CR. MISC. No.10476 of 2020(11) dt.04-01-2021 2/2 investigation, Ajay Yadav made confessional statement about the illicit relationship as aforesaid, he called the victim and Sanoj Yadv @ Sudhir Yadav (petitioner) assisted in committing the murder of the victim.

Learned counsel for the petitioner submits that Ajay Yadav is the main person who had committed the commission of crime and has been granted bail by one of the coordinate Bench of this Court in Cr. Misc. No. 66966 of 2019 on 31.01.2020. The petitioner is in custody since 03.12.2019. Looking to the entirety of the matter, let the petitioner above named be released on regular bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Nawada in connection with Akbarpur P.S. Case No. 40 of 2019, subject to the condition that one of the bailors of the petitioner shall be a close relative. The petitioner will not induce any witness or tamper with the evidence. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
