JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-03-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471, 120B/34 of the Indian Penal Code.
Earlier, anticipatory bail application to the petitioner was rejected vide order dated 09.12.2014 passed in Criminal Miscellaneous No.28728 of 2014 only on the ground that the learned Sessions Judge rejected the application of the petitioner vide order dated 11th July 2013 passd in A.B.P. No. 284 of 2013.
It is submitted by learned counsel for the petitioner that the petitioner is simply a purchaser and the persons, who had executed sale deed, have been granted anticipatory bail. This Court is not inclined to interfere with the second
Patna High Court Cr.Misc. No.12842 of 2015 (2) dt.30-03-2015 2/2 anticipatory bail application. However, this Court sees no reason for the learned court below not to consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Saharsa Sadar P.S. Case No.97 of 2013, pending before the Court of learned Chief Judicial Magistrate, Saharsa.
With the above observation, this application is, accordingly, disposed off.
