ANJANA MISHRA ORAL ORDER 10-05-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State as well as learned counsel appearing on behalf of the informant. The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 341/420/302/120(B)/34 of the Indian Penal Code. After hearing learned counsel for the petitioner and learned counsel appearing on behalf of the informant and also on perusal of the case diary, it appears that the petitioner had specific role to play, he having caught hold of the deceased while his son shot at him resulting in his death.
In view of the aforementioned facts and circumstances, I am not inclined to grant anticipatory bail to this petitioner in
Patna High Court Cr.Misc. No.7328 of 2016 (4) dt.10-05-2016 P2/2 connection with Sadar (Hajipur) P.S. Case No. 543 of 2015. It is accordingly rejected.
However, in view of the fact that the petitioner is an old man, in case he surrenders within a period of six weeks, the same may be considered expeditiously without being prejudiced by this order.
