Petitioner, already in custody, seeks bail in connection with Haspura P.S. Case No.95 of 2017, registered under Sections 399/402 of the Indian Penal Code as well as under Sections 25(1-B)a, 26, 35 of the Arms Act.

Submission is that four persons were apprehended on the spot by the police and from their possession some arms and mobiles were recovered. However, the petitioner was not apprehended at the spot, he has no criminal antecedent and only material against the petitioner is disclosure of his name by one of the apprehended accused.

Having considered the said facts and circumstances, petitioner Badri Paswan is directed to be released on bail on

Patna High Court Cr.Misc. No.12760 of 2018(2) dt.05-03-2018 2/2 furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Daudnagar, Aurangabad in connection with Haspura P.S. Case No.95 of 2017.
