JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-02-2016 The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 366, 366(A), 120B of the Indian Penal Code.
The prosecution case is that on 04.09.2011 the daughter of the informant namely Muskan Kumari went to market but thereafter she did not return. During investigation, it was found that the victim was kept in the room of the petitioner at Bangalore. The victim in her 164 Cr.P.C statement also stated that she was being kept in the room of the petitioner at Bangalore where the petitioner including other accused persons ravished her. The doctor has found the age of the victim between 17-18 years.
Considering the nature of accusation, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly the application stands dismissed
