The petitioner seeks bail in connection with Kotwali P.S. Case No. 636 of 2014 registered under Sections 147, 148, 149, 323, 307, 302 and 120-B of the Indian Penal Code, pending in the court of Additional Sessions Judge-IX, Gaya. Earlier, the prayer for bail of the petitioner was rejected vide order dated 18.12.2015 passed in Criminal Misc. No. 50968 of 2015 on merit.
Submission is that petitioner is in custody since 29.05.2015 and till today there is no progress in the trial of the petitioner.

Patna High Court Cr.Misc. No.11838 of 2017 (3) dt.26-04-2017 2/2 has been received from the court of Addl. Sessions Judge-IX, Gaya vide letter No.83, dated 19.04.2017, which shows that Charge has been framed on 03.03.2017 and summons has been issued to procure the attendance of prosecution witnesses. Having considered the facts and circumstances of the case, I am not inclined to reconsider the bail prayer of the petitioner. Accordingly, the prayer of the petitioner for grant of bail is again rejected. However, the learned Court below is directed to take effective stapes to conclude the trial of the petitioner preferably within one year.
