This application, for grant of anticipatory bail, arises out of Supaul Nadi Police Station Case No. 10 of 2019, disclosing offences under Sections 147/148/149/341/323/325/ 354-A/380/504 of the Indian Penal Code.

The allegation against the petitioners is that the petitioner, along with others, entered into the house of the informant, armed with iron-rod, lathi etc. and started abusing and assaulting the sister of the informant. It has further been alleged that the petitioner outraged the modesty of the sister of

Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in this case due to previous enmity, which would be evident from the First Information Report itself. He further submits that both the parties are agnates from the common ancestor and there is land dispute between them. He also submits that the petitioner is a student and is pursuing his graduation course. He further submits that the petitioner has got no criminal antecedent. Having regard to the submissions made on behalf of the parties and taking into consideration the fact that both the parties are agnates, there is land dispute between them and the petitioner is a student, I am inclined to grant the petitioner privilege of anticipatory bail.

This application is, accordingly, allowed.

Let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul, in connection with Supaul Nadi Police Station Case No. 10 of 2019, subject to the condition laid down
