The petitioner wants to renew his prayer of bail, which was earlier rejected vide order dated 08.09.2016 passed in Cr. Misc. No. 31152 of 2016, on the ground that the petitioner is suffering in custody since 23.09.2015 whereas co-accused Pawan Yadav has been allowed bail, other co-accused have also been allowed bail, the petitioner has not been put on test identification parade, nothing has been recovered from his conscious possession and looted potatoes are alleged to be recovered from the house of the petitioner which is a joint house and as such the petitioner deserves sympathetic consideration.
Learned APP opposes the prayer of bail by showing the alleged recovery.
In the facts and circumstances stated above, finding no
Patna High Court Cr.Misc. No.21299 of 2017 (2) dt.21-06-2017 good ground for reconsideration of prayer for bail of the petitioner, again his prayer for bail stands rejected. However, learned trial court is again directed to expedite the trial and conclude the same as early as possible, preferably within six months from the date of receipt/production of a copy of this order, failing which, the petitioner, if at no fault, may be at liberty to renew his prayer of bail.
