The petitioner seeks bail in Sugauli P.S. Case No. 02 of 2021, registered for the offence punishable under Sections 419, 420 and other allied sections of the Indian Penal Code. As per the prosecution case, 21 revenue documents has been recovered from house of this petitioner. It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case at the behest of one Ex-MLA Ram Chandra Sahani. Petitioner is innocent and the document which were seized from the petitioner and other accused persons, was taken away by force and under the threat

Patna High Court CR. MISC. No.22015 of 2021(2) dt.16-07-2021 2/2 by one Vivek Jaiswal, the Head Clerk of local police station and 5-7 police personnel who arrived at the residence as the owner of the documents and the same has been filed in the court (Annexure-3). Petitioner has got clean antecedent and he is in custody since 03.01.2021. Investigation is complete. Considering the period of custody and clean antecedent of the petitioner, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Sugauli P.S. Case No.

02 of 2021, subject to following conditions:- (i) The petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the Court and in the event of failure on two consecutive dates without sufficient reasons, his bail bond shall be liable to be cancelled by the court below. (ii) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
