2. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 354(B), 379 and 498(A) of the Indian Penal Code and Section 3⁄4 of the D.P. Act pending in the learned court below.

3. The allegation against the petitioner is of torturing the informant in association of his family members on account of non-fulfillment of demand of dowry and of ousting her out of the matrimonial house.

4. Learned counsel for the petitioner submits that the

He further submits that petitioner is ready to keep his wife with full dignity and honour but the complainant herself is not willing to live with the petitioner and has deserted him. He further submits that petitioner has got no criminal antecedent as stated in para-3 of the bail application.

5. Learned APP for the State along with learned counsel for the complainant opposes for prayer for bail and submits that complainant is also willing to live with her husband provided that she is not being tortured.

6. Considering the aforesaid facts and circumstances and the fact that both parties have agreed to live with each other, let the petitioner, named above, in the event of his arrest/surrender before the learned court below within a period of six weeks from today, be released on provisional bail for a period of six months, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of the learned Court below, where the case is pending/Successor court, in connection with Complaint Case No.690/2020, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
