JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-06-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. At the very outset, it is pointed out that petitioner no. 3, namely, Nawlesh Sharma has already been arrested and, accordingly, his prayer for anticipatory bail stands dismissed being infructuous.
So far as rest petitioners are concerned, admittedly, they are ladies and there is only allegation against them that they assaulted the injured by fists and slaps.
The injury report of injured reveals that she sustained only two injuries said to be caused by hard and blunt substance.
Patna High Court Cr.Misc. No.12659 of 2015 (3) dt.26-06-2015 Considering the aforesaid facts and circumstances as well as submissions of the parties, it is ordered that petitioners no. 1, 2 and 4, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in Tekari P.S. Case No. 26 of 2015 subject to condition as laid down under Section 438(2) of the Cr.P.C.
