JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 04-04-2016 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Saraiya Police Station Case No. 290 of 2015, disclosing offences under Sections 419, 420 and 471/34 of the Indian Penal Code.

There are three persons named in the First Information Report. It is alleged that the named accused persons, in the name of helping the informant in withdrawal of the amount from the ATM with the debit card of the informant, attempted to flee away with the money so withdrawn. Upon cry for help raised by the informant, police came and co-accused, Akash Kumar, was arrested;

Patna High Court Cr.Misc. No.7864 of 2016 (2) dt.04-04-2016 2/3 whereas, the present petitioner and Arif are said to have fled away.

Learned Counsel appearing on behalf of the petitioner has submitted hat the said Akash Kumar was arrested at the place of occurrence and has been granted regular bail by the Court of the learned Sub Divisional Judicial Magistrate, Muzaffarpur (West). It has been stated that the petitioner has no criminal antecedent. Considering the submission, as above, this application is allowed.

Let the petitioner, Md. Farukh @ Farukh, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur, in connection with Saraiya Police Station Case No. 290 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be
