Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 186, 224, 225, 341, 342, 323, 325, 307, 332, 333, 337, 338, 353 of the Indian Penal Code.
The prosecution case is that the informant and other police officers of the Chand P.S. took the apprehended accused Bokhari Yadav to investigate the case of stolen diesel engine pump set, when on alarm being raised by the arrested accused, the mob assaulted the police personnel, as a result the in-charge of Chand P.S. received grievous injury. It is submitted by the learned counsel for the petitioners that petitioners are not related or family members of
Patna High Court Cr.Misc. No.9337 of 2016 (2) dt.01-03-2016 the arrested accused. Accusation is against the mob of 45 named and 100-150 unknown and statement has been made in para-3 of the petition that petitioners have no criminal antecedent.
Considering the accusation against the mob and the co-accused being granted bail by a Coordinate Bench of this Court vide Cr. Misc. No. 5527 of 2016, it is a case for consideration of prayer for regular bail.
Let the learned court below consider the prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Chand P.S. Case No. 118 of 2015, pending in the court of learned Chief Judicial Magistrate, Kaimur at Bhabua.
With the above observation this application is disposed of.
