The present petition has been filed with a prayer to restore Cr. Misc. No. 49804 of 2016, which stood dismissed due to part non- compliance of the order dated 21.11.2016. After hearing learned counsel for the parties and considering the facts disclosed in the petition, same is allowed. Let Cr. Misc. No. 49804 of 2016 be restored to its original file.

It is clarified that if the order dated 21.11.2016 is not fully complied within two weeks from today, the Cr. Misc. No. 49804 of 2016 shall stand dismissed without further reference to a Bench.

Learned counsel for the petitioner requests that defect no. 14(2) which has been pointed out by the office may be
