Petitioner seeks bail in connection with Ara Town PS case no. 04 of 2017 for offences under Section 25(1-b)(a)/35 Arms Act.

Learned counsel for the petitioner submits that in this case, petitioner has been implicated on the basis of statement of co-accused Manzit Gor who was arrested in connection with Ara Town PS case no. 03 of 2017. It is further submitted that non of the alleged articles has been recovered from the conscious possession of the petitioner rather the same has been recovered from his house. It is further submitted in para 10 of the petition that co-accused Gorakh Mahto has already been granted bail vide

Patna High Court Cr.Misc. No.21799 of 2017 (3) dt.01-06-2017 2/2 Cr.Misc. no. 16680 of 2017 and the petitioner is in custody since 05.01.2017.

Accordingly, petitioner namely Chandra Prakash Mahto is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate Bhojpur at Ara in connection with Ara Town PS case no. 04 of 2017.
