JUSTICE BIRENDRA KUMAR ORAL ORDER 20-03-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Sections 147/149/337/338/353/427/188 of the Indian Penal Code and Section 3/4 of the Prevention of Damage to Public Property Act, 1984.

Learned counsel for the petitioner submits that unemployed youth were making protest for irregularities committed by the Railway Board in the matter of appointment and large number of students were making protest but there is no specific overt act alleged against the petitioner, there is general and omnibus allegation against named and not named people and the petitioner has got no criminal antecedent.

No.15474 of 2018 (2) dt.20-03-2018 P2/ Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Nawada Town P.S. Case No.72 of 2018, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
