The petitioner seeks bail in Manigachhi (Nehra O.P.) P.S. case No. 22/2020 registered under Section 272, 273/34 of the Indian Penal Code and u/s 30(a) of the Bihar Prohibition & Excise Act.

A Bolero jeep is said to have been parked in the eastern side of the house of the petitioner from which 645.65 liter of illicit liquor was recovered.

The learned counsel for the petitioner submits that petitioner is not the owner of the vehicle and petitioner had no knowledge about the parking of vehicle. The vehicle bearing registration No. BR 07GA- 4998 stands in the name of Chanda Kumari. Subhash Prasad is husband of Chanda Kumari, who is own brother of the petitioner, and the petitioner has no manner

Taking into consideration the facts that the vehicle is standing in the name of Chanda Kumari from which about 650 liters of liquor was recovered, the petitioner, above named is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Darbhanga in connection with Manigachhi (Nehra O.P.) P.S. case No. 22/2020.
