The petitioner seeks bail in Bela P.S. Case No. 62 of 2016 registered under Section 392 of the Indian Penal Code. The informant lodged a case against four unknown persons alleging therein that four persons on three motorcycles came and looted his bag containing Rs. 23 lakhs Nepali currency and fled away. One motorcycle bearing registration no. BR06AK4784 was used in the robbery along with one Apache and Glamour motorcycle.

Learned counsel for the petitioner submits that the name of the petitioner figured in the case in the confessional statement of Braj Mohan Sah from whose possession one motorcycle bearing registration no. BR06AK4784 and Rs. 6 lakhs

Patna High Court Cr.Misc. No.21790 of 2017 (2) dt.11-05-2017 2/2 looted Nepali currency were recovered. The petitioner was arrested and remanded in the case on 09.12.2016, but the petitioner has not been put on T.I.P. No looted article was recovered from the possession of the petitioner. Braj Mohan Sah and Jitendra Kumar @ Jitendra Rai have already been enlarged on bail.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Bela P.S. Case No. 62 of 2016.
