This application for regular bail arises out of Bathnaha P.S. Case No. 160 of 2019, disclosing offence punishable under Sections 363, 365/34 of the Indian Penal Code.

The husband of the alleged victim is the informant. Statement of the victim has been recorded under Section 164 of the Cr.P.C., a copy of which has been brought on record by way of Annexure-2 to this application.

It appears from the statement recorded under Section 164 of the Cr.P.C. that according to the victim, she had left her husband's house out of anguish because of her husband's conduct and she was not kidnapped or abducted at any point of

Considering the statement of the alleged victim under Section 164 of the Cr.P.C., a case for grant of regular bail is made out. This application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in Bathnaha P.S. Case No. 160 of 2019. This is subject to the condition that the petitioner shall present himself before the Police/ Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
