2. The petitioner is in custody in a case registered for the offence punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per allegation in the FIR, it is a case of murder of the brother of the informant by the unknown persons.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that petitioner is not named in the FIR and his name figured on the basis of confessional statement of co-accused Gautam Kumar. He next submits that similarly situated coaccused has already been granted bail by this Court passed in

Patna High Court CR. MISC. No.15906 of 2025(2) dt.19-03-2025 2/2 Cr. Misc. Nos. 12444 of 2024 and 3638 of 2024.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

6. In view of the aforesaid facts and circumstances as also the fact that similarly situated co-accused have been granted bail by this Court, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IX, Begusarai in Khodawandpur P.S. Case NO. 208 of 2023.
