JUSTICE MADHURESH PRASAD ORAL ORDER 09-05-2019 Counsel for the petitioner submits that now the petitioner is in possession of relevant documents to substantiate his appointment on a post on 8.9.1077. He submits that relying upon the same he would approach respondent No. 2 for consideration afresh.
Since the claim is now to be made on the basis of fresh document which had already been allowed to be relied upon in the earlier proceedings arising out of CWJC No. 6990, of 2009 this Court would permit the petitioner to stake his claim on the basis of said document. Let the matter thereafter be considered by respondent No. 2.
Patna High Court CWJC No.4104 of 2016(2) dt.09-05-2019 2/2 Since fresh documents are being relied upon which was not there at the time of issuance of the order dated 5.5.2012, which is impugned in the instant writ proceedings, this Court would observe that the order dated 5.5.2012 will not stand in the way of fresh consideration.
