JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 04-03-2020 Heard learned counsel for the petitioner and the State. The petitioner is apprehending arrest in connection with Shambhuganj P.S. Case No. 95 of 2018 for the offence under Sections 354(B), 504, 506/34 of the Indian Penal Code and Section 8 of POCSO Act.

Allegation against the petitioner is that he along with hundred unknown persons provided safe passage to Vijayant Kumar Singh who has made intent to outrage the modesty of a class 10th student.

Learned counsel for the petitioner submits that Vijayant Kumar Singh has been granted bail and similarly circumstanced other co-accused who provided safe passage to Vijayant Kumar Singh have been granted bail by this Court.

No.10802 of 2020(2) dt.04-03-2020 2/2 Considering the fact that the petitioner has no criminal antecedent, the Court is inclined to grant bail to the petitioner, in the event of arrest or surrender within four weeks from today, on furnishing bail bond of Rs.50,000/- (Fifty thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-I-cum-Special Judge (POCSO), Banka in connection with Shambhuganj P.S. Case No. 95 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
