The petitioner has preferred this application for grant of regular bail in a case registered under section 392 of the Indian Penal Code.

As per the prosecution case, three accused persons on the point of pistol looted the informant of Rs. 2,22,800/- in cash. It is submitted by learned counsel for the petitioner that the petitioner is not named in the FIR. He was falsely implicated in Kochadhaman P.S. Case no. 214 of 2020 and on the basis of his confessional statement in the said case recorded before the police he was remanded in the instant case on 22.10.2020. There is no recovery of any incriminating article from his possession. Inspite of being in custody for more than one year and chargesheet having been submitted he has not been put on T.I. parade.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for over one year, the petitioner is directed to be enlarged on bail in connection with Kochadhaman P.S. Case no. 198 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj.
