This application for regular bail arising out of Belhar P.S. Case No.85 of 2019, disclosing offences punishable under Sections 341,323,307/34 of the Indian Penal Code. The FIR was initially registered for the offence punishable under Section 307 of the Indian Penal Code. Since the victim died after filing of the FIR, Section 302 of the Indian Penal Code has been added. It is apparent from the FIR that there is general allegation against all persons named in the FIR of having assaulted the deceased with fists and slaps. Learned counsel appearing on behalf of the petitioner has submitted that the postmortem does not suggest any external injury and the petitioner and other members of the family have
Patna High Court CR. MISC. No.10613 of 2020(2) dt.02-03-2020 2/2 been falsely implicated because of family dispute and the persons named in the FIR are close agnates.
Considering the submission so advanced on behalf of the petitioner, this application is allowed.
Let the petitioner above-named be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in Belhar P. S. Case No. 85 of 2019.
