This application is directed against the order dated 19.02.2013 passed in Case No. M.R. No. 03 of 2009 under Section 133 Cr.P.C., whereunder the S.D.M, Madhubani ordered to remove the encroachment over the land in dispute arriving at the conclusion that there is encroachment over the land in dispute by the Second Party/petitioner by constructing the house & Latrine.
On going through the impugned order, I do not find any illegality amounting to abuse of process of Court for interference in jurisdiction under Section 482 Cr.P.C. Accordingly, this application is hereby dismissed.
