JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 324, 302 and 307/34 of the Indian Penal Code and Section 27 of the Arms Act. It is alleged that on the order of co-accused Vishwamitra Chaubey and Ankesh Chaubey, co-accused Mannu Chaubey caused two firearm injuries to the informant when this petitioner caused injury with Barachhi on the lower portion of the abdomen of Krishnath Chaubey who subsequently succumbed to the injuries.
It is submitted by learned counsel for the petitioner that there is no accusation of repetition of blow and there is counter version of the occurrence also.
The aforesaid facts may constitute ground for
Patna High Court Cr.Misc. No.9760 of 2015 (2) dt.22-04-2015 2/2 consideration of prayer for regular bail.
Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Taraiya P.S. Case No. 23 of 2014 pending in the court of learned JM, 1st Class, Chapra District Saran.
Accordingly, the application is disposed of.
